I. GAVEN STANDARD WARRANTY STATEMENT

1. WARRANTIES – This warranty is extended to the original buyer and applies to all Gaven Industries products purchased or employed for the service normally intended, except those products specifically excluded.

2. If your Gaven product purchased from us fails in normal use because of defect in workmanship or materials within one year from the date of shipment, we will repair or replace (at our option) the part(s) with new, reworked, or a remanufactured part(s) with no charge to you, at our factory.

3. Notification of a defect must be within one year from date of shipment. Assuming that Gaven Industries concurs that the complaint is valid, and is unable to correct the problem without having the product shipped to Gaven:

• Customers with products in need of repair must obtain an RMA number, properly pack, insure, prepay the shipping charges and ship the defective product or part to our warehouse located at 6655 North Noah Drive, Saxonburg, PA 16056.
• RMA numbers can be obtained through Gaven’s website. See “Warranty Request/RMA”
• Shipping instructions will be provided with the RMA confirmation

4. Gaven Industries will repair or replace the defective product or part and pay for its return to you, provided the repair or replacement is due to a cause covered by this warranty.

II. SPECIAL CONSIDERATIONS

Gaven is not responsible for damage due to:

• Defects or failures caused by buyer or user abuse or misuse. This includes products that have been misused, neglected or damaged on accident.
• Defects or failures caused by unauthorized attempts to repair or alter the product in any way by persons other than Gaven Industries employees. This includes units that have been disassembled.
• Replacement parts installed by a vendor not authorized for repair.
• Acts of God and force majeure.
• Modification of a door leaf and/or frame or any subassembly.
• Warranty is voided if serial number is removed.

III. GENERAL DOOR WARRANTY

Seller warrants that its work (except for those aspects of the work covered by special warranties) will be free from defects in material and workmanship for a period of
Fifteen (15) years from the date of delivery for the door frame and door leaf.

• One (1) year from the date of shipment of the door hardware and controllers, barring abuse or misuse of the doors and barring “force majeure”, which includes all other circumstances and actions beyond the direct and immediate control of the Seller. The seller’s liability under this warranty shall be limited to repair of its work by the seller alone to meet the original specifications. Seller shall not be liable for the cost of inspecting its work for defects or for repair by any person other than the Seller.

Warranty is voided if:

• Gaven door assembly is modified in any way.
• Improperly cleaned or due to unapproved chemical application. Approved chemical agents provided in manual documents.
• The serial number is removed
• Hardware and/or controllers are disassembled or manipulated.

IV. SPECIAL WARRANTY FOR R.F. SHIELDED AIR SEALS

Seller warrants to Owner, only, that the R.F. Shielded Air Seals (hereinafter referred to as Air Seals) in the R.F. door (which is a normal wear item) will not fail due to deterioration for a period of one (1) year from the date of shipment. The warranty shall not apply to:

• a) Defects or failures caused by buyer or user abuse or misuse.
  * Products that have been misused, neglected, or damaged by accident.
• b) Air Seals which are not handled, installed, used, or cleaned in accordance with Seller’s published instructions;
• c) Replacement Air Seals beyond the warranty period applicable to the original gaskets. The seller’s liability under this warranty shall be limited to the replacement of the Air Seals. Seller shall not be liable for the cost of removal or installation of such Air Seals, nor incidental, consequential, or other damages in connection with the Air Seal.
• d) Defects or failures caused by unauthorized attempts to repair or alter the product in any way by persons other than Gaven Industries employees.
• e) Includes airseals/products that have been disassembled.

V. DISCLAIMER OF OTHER WARRANTIES

The warranties provided under section 1, above, are strictly limited to their terms and are in lieu of all other warranties, expressed, implied, and/or statutory.

VI. EXCLUSIVE REMEDY, EXCLUSION OF CONSEQUENTIAL DAMAGES

Owner expressly agrees that the owner’s sole and exclusive remedy for breach of warranties set forth, above, for any tortuous conduct, or for any cause of action, shall be the remedies set forth in section 1. Owner further specifically understands and agrees that, except as provided in section 1, no remedy shall be available to the owner, including but not limited to claims for incidental, consequential, special, or punitive damages, for any cause whatsoever, or injury or death of persons or damage to property or any other consequential, economic, or incidental loss. Under no circumstances will the Seller be liable for loss of anticipated profits, or any other loss caused by reason of the nonoperational of, or the increased expense of operation caused by Seller work. This exclusion shall apply to all claims, whether sounding in tort, contract, or otherwise, and shall apply to all damages.

*SPECIAL NOTE: If the items furnished by Gaven Industries were not installed by Gaven Industries or an authorized installer, Gaven Industries shall not be liable for all defects, deterioration, etc. which may be determined by Gaven Industries to be caused by the installation. Gaven Industries shall only be responsible for issues attributed to factory defects.

** IMPORTANT – Customers who wish to return defective products must obtain an RMA before shipping to Gaven. Failure to obtain an RMA before shipment may result in delay in the repair/replacement and the return of your product.
